July 1, 2011 – The law has changed regarding Diligent Effort forms and eligibility to export. As of now, risks of the following classes no longer are subject to the restrictions placed in 626.916 as to eligibility for export. Furthermore, you do not have to complete and send us a “Diligent Effort Form” showing rejecting admitted carriers. You are required to have the insured sign a statement acknowledging the fact that this is a quote from a surplus lines carrier. While it is the agent’s responsibility to obtain and keep this form, we do ask that you send us a copy with your binding request. Additional classes will be added effective October 1, 2011, but as of now, these are the only classes which apply:
· Excess or umbrella
· Surety and fidelity
· Boiler and machinery and leakage and fire extinguishing equipment
· Errors and omissions
· Directors and officers, employment practices, and management liability
· Intellectual property and patent infringement liability
· Advertising injury and Internet liability insurance
· Property risks rated under a highly protected risks rating plan
